Short Title .  - This Act shall be known as the / Traditional and Alternative Medicine Act (TAMA) of 1997  ./ART#C& #$(#D#N$ PR#NC#P& ''ection 2. Declaration of Policy  .  - It is hereby declared the policy of the State to improve the quality and delivery of health care services to the Filipino people throuh the development of traditional and alternative health care and its interation into the national health care delivery system!It shall also be the policy of the State to seek a leally workable basis by which indienous societies would own their knowlede of traditional medicine! hen such knowlede is used by outsiders# the indienous societies can require the permitted users to acknowlede its source and can demand a share of any financial return that may come from its authori$ed commercial use! 'ection 3. Objectives .  - The ob%ectives of this Act are as follows:&a' To encourae scientific research on and develop traditional and alternative health care systems that have direct impact on public health care(&b' To promote and advocate the use of traditional# alternative# preventive and curative healthcare modalities that have been proven safe# effective# cost effective and consistent with overnment standards on medical practice(&c' To develop and coordinate skills trainin courses for various forms of traditional and alternative health care modalities(&d' To formulate standards# uidelines and codes of ethical practice appropriate for the practice of traditional and alternative health care as well as in the manufacture# quality control and marketin of different traditional and alternative health care materials# natural and oranic products# for approval and adoption by the appropriate overnment aencies(  &e' To formulate policies for the protection of indienous and natural health resources and technoloy from unwarranted e)ploitation# for approval and adoption by the appropriate overnment aencies(&f' To formulate policies to strenthen the role of traditional and alternative health care delivery system( and&' To promote traditional and alternative health care in international and national conventions# seminars and meetins in coordination with the *epartment of Tourism# *uty Free +hilippines# Incorporated# +hilippine ,onvention and isitors ,orporation and other tourism-related aencies as well as non-overnment orani$ations and local overnment units! ART#C& ##D *#N#T#)N )* T R''ection 4. Definition of Terms .  - As used in this Act# the followin terms shall mean:&a' . Traditional and alternative health care . - the sum total of knowlede# skills and practices on health care# other than those embodied in biomedicine# used in the prevention# dianosis and elimination of physical or mental disorder!&b' . Traditional medicine . - the sum total of knowlede# skills# and practice on health care# not necessarily e)plicable in the conte)t of modern# scientific philosophical framework# but reconi$ed by the people to help maintain and improve their health towards the wholeness of their bein# the community and society# and their interrelations based on culture# history# heritae# and consciousness!&c' . Biomedicine . - that discipline of medical care advocatin therapy with remedies that produce effects differin from those of the diseases treated! It is also called .allopathy.#.western medicine.# .orthodo) medicine.# or .cosmopolitan medicine.!&d' .  Alternative health care modalities . / other forms of non-allopathic# occasionally non-indienous or imported healin methods# thouh not necessarily practiced for centuries nor handed down from one eneration to another! Some alternative health care modalities include refle)oloy# acupressure# chiropractics# nutritional therapy# and other similar methods!&e' . Herbal medicines . - finished# labelled# medicinal products that contain as active inredient0s serial or underround part0s of plant or other materials or combination thereof# whether in the crude state or as plant preparations!+lant material includes %uices# ums# fatty oils# essential oils# and other substances of this nature! 1erbal medicines# however# may contain e)cipients in addition to the active inredient&s'! Medicines containin plant material&s' combined with chemically-defined activesubstances# includin chemically-defined# isolated constituents of plants# are not considered to be herbal medicines!&f' . Natural product  . - those foods that row spontaneously in nature whether or not they are tended by man! It also refers to foods that have been prepared from rains# veetables# fruits# nuts# meats# fish# es# honey# raw milk# and the like# without the use or addition of  additives# preservatives# artificial colors and flavors# or manufactured chemicals of any sort after harvest or slauhter!&' . anufacture . - any and all operations involved in the production# includin preparation# propaation# processin# formulatin# fillin# packin# repackin# alterin# ornamentin# finishin# or otherwise chanin the container# wrapper# or labellin of a consumer product in the furtherance of the distribution of the same from the oriinal place of manufacture to the person who makes the final delivery or sale to the ultimate consumer!&h' . Traditional healers . - the relatively old# hihly respected people with a profound knowlede of traditional remedies!&i' . !ntellectual property rights . - is the leal basis by which the indienous communities e)ercise their rihts to have access to# protect# control over their cultural knowlede and product# includin# but not limited to# traditional medicines# and includes the riht to receive compensation for it! ART#C& ###T% P%#&#PP#N #N'T#T(T )* TRAD#T#)NA& AND A&T RNAT#+ % A&T% CAR 'ection 0. Philiine !nstit te of Traditional and Alternative #ealth $are .  - There is hereby established a body corporate to be known as the +hilippine Institute of Traditional and Alternative 1ealth ,are# hereinafter referred to as the Institute! The Institute shall be attached to the *epartmentof 1ealth! Its principal fla office shall be in Metro Manila# but it may establish other branches or offices elsewhere in the +hilippines as may be necessary or proper for the accomplishment of its purposes and ob%ectives! 'ection 1. Po%ers and & nctions .  - In furtherance of its purposes and ob%ectives# the Institute shallhave the followin powers and functions:&a' To plan and carry out research and development activities in the areas of traditional and alternative health care and its ultimate interation into the national health care delivery system(&b' To verify# packae and transfer economically viable technoloies in the field of traditional and alternative health care# ivin emphasis on the social enineerin aspects necessary for roup endeavor(&c' To provide the data base or policy formulation that will stimulate and sustain production# marketin and consumption of traditional and alternative health care products(&d' To orani$e and develop continuin trainin prorams for physicians# nurses# pharmacists# physical therapists# and other professional health workers and students# as wellas scientists# research manaers and e)tension workers in the field of traditional and alternative health care(&e' To formulate policies that would create public awareness throuh educational activities# conventions# seminars# conferences# and the like by focusin on the promotion of healthy livin for preventin diseases# thereby upliftin the health care industry(  &f' To acquire or obtain from any overnmental authority whether national or local# forein or domestic# or from any person# corporation# partnership# association or other entity# such charters# franchises# licenses# rihts# privilees# assistance# financial or otherwise# and concessions as are conducive to and necessary or proper for the attainment of its purposes and ob%ectives(&' To receive and acquire from any person and0or overnment and private entities# whether forein or domestic# rants# donations and contributions consistin of such properties# real or personal# includin funds and valuable effects or thins# as may be useful# necessary or proper to carry out its purposes and ob%ectives and administer the same in accordance with the terms of such rants# donations and contributions# consistent with its purposes and ob%ectives(&h' To serve as the coordinatin center of a national network of traditional and alternative health care stations located in the different reions of the country(&i' To formulate a code of ethics and standards for the practice of traditional and alternative health care modalities for approval and adoption by the appropriate professional and overnment aencies(&%' To formulate standards and uidelines for the manufacture# marketin and quality control of different traditional and alternative health care materials and products for approval and adoption by the 2ureau of Food and *rus(&k' To coordinate with other institutions and aencies involved in the research on herbal medicines(&3' To adopt and use a corporate seal(&m' To sue and be sued in its corporate name(&n' To succeed by its corporate name(&o' To adopt its bylaws and promulate such rules and reulations as may be necessary or proper to implement this Act# and to amend or repeal the same from time to time(&p' To enter into# make and e)ecute contracts and areements of any kind or nature(&q' To borrow# raise or obtain funds# or to enter into any financial or credit arranement in order to support or carry out its research prorams# finance its capital and operatin e)penses# sub%ect to pertinent laws overnin public debts and e)penditure(&r' To invest in# purchase or otherwise acquire# own# hold# use# mortae# plede# encumber# sell# assin# convey# e)chane# or otherwise deal in real and0or personal properties of whatever kind and nature# or any interest therein# includin shares of stock# bonds# notes# securities and other evidences of indebtedness of natural or %uridical persons# whether domestic or forein and whether overnment or private(&s' To e)ercise all the powers of a corporation under the 4eneral ,orporation 5aw# insofar assuch powers are not in violation of the provisions of this Act( and
